3) Notice of exemption

Due to the promotion of charitable and non-profit purposes according to the last received Notice of exemption from the Tax Office of the City of Freiburg dated 29.10.21 (tax number 06469/40428), AMICA is exempt from corporate income tax for the years 2018 to 2020 according to § 5 Para. 1 No. 9 of the Corporate Income Tax Law, and from trade tax according to § 3 No. 6 of the Trade Tax Law. In addition, you will find the decision according to § 60a Paragraph 1 AO about the separate assessment of compliance with the statutory conditions according to SS 51, 59, 60, and 61 AO. The next regular non-profit audit for the financial years 2021-2023 will take place in 2024. Until then, the notice of exemption from 2021 will apply.

All our expenditures are audited on a regular basis. We disclose the use of public funds to the ministries. The financial reports and the reports on the use of funds are then reviewed again by the Federal Audit Office. Our accounting is done by a tax agent. He also verifies the proper accounting and handles the regular audits in which wages, taxes and salaries of AMICA e.V. are audited.

As a non-profit organization, we report all income and expenditures to the tax office in a 3-year cycle. The accreditation of the non-profit status depends on this. The next audit is due in 2024 for the financial years 2021-2023.

Within the framework of the ‘Vereinsregularien’ (regulations of organizations and associations), our cash register is audited annually. The auditors are given access to the accounting and check randomly selected vouchers. They then report to the general meeting, which decides on the basis of this report to discharge the treasurer and the board.

Why AMICA does not have a donation seal?
Many organisations have themselves audited by independent organisations and certified with a donation seal. The best known is the DZI seal of the Central Institute for Social Issues. The audit of the organisation on which the awarding of the seal is based involves costs that we would have to finance from donations. The internal benefit of the seal is primarily to be able to raise more donations. As a small organisation with a transparent financial structure and a clear financial volume, we currently do not see the effort of certification in relation to our expenses.
